1. BOOKING FEE:
A booking fee of 20% of the total, along with full acceptance of the terms & conditions secures the time and services of the Photographer, together with a signed contract. Dates are reserved only when this booking fee is paid by Cash, Bank transfer, or cheque. This is non-refundable or non-transferable in the event of cancellation, it being agreed loss suffered by the photographer due to cancellation.
The booking fee is deducted form the final balance due.
The balance is to be made no later than 1 month prior to the wedding day. Payment for additional album photographs, prints & frames is made after the wedding at the time of ordering.
Proof online album containing all images taken during the day will be available for the client to view within 12 weeks after the wedding date. After which time the client then has 12 weeks to choose and select their images for the chosen package.
3. CREATIVE LICENCE:
S.Howard Photography Ltd shall be granted creative and artistic license in relation to the choice of locations and poses used. The client understands and accepts that the photographic coverage will be as the photographer's professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client's wishes. The Photographer/s will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement due to changes of the weather and the availability and willingness of subjects. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images required or requested.
The 1998 Copyright, Designs, and Patents Act assigns copyright to S.Howard Photography Ltd.
It is contrary to the Act to copy or allow to be copied photographically/ electronically or by any other means an image created as part of this contract without the permission of the photographer/s in writing. Any breaking of seals / downloading of images electronically without permission or selling will presume a breach of copyright.
5. LICENSED IMAGES:
Images supplied by us on a Disc or USB as High Resolution JPEG format digital files will be suitable for printing. They are licenced to you for sharing or displaying electronically with family & friends, and for printing by the bride & groom ONLY. Your remaining family and guests must view and purchase prints from the password protected 'Client Area' on our website. Images files must not be copied, altered or sold in anyway. Images are not to be shared/copied to any supplier you may use, this can only be done directly via S.Howard Photography Ltd due to GDPR, copyrights and watermarking.
The Photographer/s will be the sole professional (still) photographer at the venues specified. We do however positively encourage family, friends, and other guests to take photographs throughout the day.
All image sizes are nominal. The photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film / digitally the exact colour as seen by the human eye. For a booking involving a church ceremony or at certain venues, the photographers movements are sometimes restricted by the official in charge. The area from what the photographer is able to cover the ceremony may not be the photographers choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
8. FORCE MAJEURE:
a. The due performance of the contract is subject to alteration or cancellation by The Photographer(s) owing to any cause beyond their control (i.e. sudden illness/injury).
b. The Photographer(s) have other professional photographers who will be contacted by their staff (or family) in the event that they are not able to attend your booking due to clause 7a.
c. In the event of cancellation by The Photographer(s) (although all attempts will be made to arrange for another photographer to be present – see clause 7b) The Photographer(s) liability shall be limited to a full refund of any deposits and fees paid.

10. NEGATIVES / DIGITAL FILES:
Negatives/digital files remain the property of the photographer/s. Should negatives or digital files be lost, damaged or destroyed for reasons beyond control The Photographer(s) liability shall be limited to a full refund of any deposits and fees paid, but shall not include a refund for any goods already received.
If The Client(s) should have to cancel a booking the following cancellation fees (as may be appropriate to their case) will become due immediately upon said cancellation.
a. Cancellation within one week of booking and more than six complete months to go until contract date shall forfeit any monies paid.
b. Cancellation with less than six months to go until contract date - full price for the complete package booked.
c. New date transfers require a NEW non- refundable booking fee.
The said sum shall be payable as compensation as an estimate of the loss the photographer/s would suffer.
All images will be adjusted for exposure, brightness, contrast, sharpness etc. The Photographer's judgement regarding these corrections and the number of images put forward to the client for preview shall be deemed correct.
Retouching, digital manipulation and artist finishing is available to the client as an option at extra cost.
14. ABUSIVE BEHAVIOUR:
S.Howard Photography Ltd will not tolerate any level of verbal abuse or aggression. Either will result in the immediate suspension of coverage.
15. COMPLAINTS / RECEIPT OF GOODS:
The Photographer(s) must be notified in writing (sent by special delivery or email) within two working days of The Client(s) being in receipt of their order in the case of error, shortage or damage as mistakes cannot be rectified after this period. It is advised that all digital images are backed up to a separate location within this two day period as USBs & DVD can easily be damaged or erased for which S.Howard Photography Ltd can’t be liable after this time.
Any complaints regarding the photographer should first be raised by the client with the S.Howard Photography Ltd in writing within 21 days from the date on the contracted wedding. In the unlikely event of an unresolved complaint the client may request the 'Society of Wedding & Portrait Photographers' (SWPP) to mediate but only on the basis that its decision shall be final and binding upon both parties.
The Client(s) are hereby advised to take out an insurance policy to cover any expenses in the event of cancellation.
18. COUNTY OF JURISPRUDENCE:
This contract is made under, and subject to English Law.
